- use of free tools made available through Agent Hub; and
- related public website features unless separate terms are expressly stated.
These Terms do not replace separate contractual terms that may apply to paid codeofwhisper services, individually commissioned work, subscriptions, or downloadable software.
Downloadable software, including future codeofwhisper software products, may be subject to separate licence terms or an End User Licence Agreement (EULA).
2. Agent Hub and free tools
Agent Hub provides free digital tools intended to help users with practical tasks, calculations, organization, planning, analysis, drafting, or similar purposes.
Unless expressly stated otherwise, use of these tools is free of charge.
The tools may use automated rules, calculations, artificial intelligence, or a combination of technologies depending on the particular tool.
Tool outputs may include calculations, suggestions, classifications, generated text, estimates, recommendations, or other automatically produced results.
3. Tool outputs and user responsibility
Agent Hub tools are designed to assist users, not to replace their own judgment.
Although we aim to make the tools useful and reliable, automated outputs may occasionally be incomplete, inaccurate, outdated, unsuitable for a particular situation, or based on information entered by the user.
You are responsible for reviewing an output before relying on it or using it for an important decision.

Please do not submit confidential, sensitive, personal, proprietary, or third-party information unless the relevant tool is clearly intended to process that type of information and you are permitted to provide it.

If you submit optional feedback, it is private pending review. We may display it only when you expressly consent to publication and it is approved. You grant codeofwhisper permission to reproduce and display that approved feedback, together with any optional display name and general location you supplied; you may instead submit anonymously.
5. Acceptable use
You may use codeofwhisper and Agent Hub tools only for lawful purposes.
You must not intentionally:
- use the website or tools in violation of applicable law or the rights of another person;
- attempt to disrupt, damage, overload, disable, or interfere with the website, its tools, infrastructure, or security;
- attempt to gain unauthorized access to systems, accounts, data, administrative functions, or restricted areas;
- bypass or attempt to defeat access controls, technical safeguards, rate limits, or security mechanisms;
- introduce malware, malicious code, destructive content, or other harmful material;
- use automated methods to scrape, copy, extract, reproduce, or systematically harvest substantial parts of the website or its tools without permission;
- misrepresent a codeofwhisper tool, service, website, output, or product as your own official codeofwhisper product or service;
- falsely imply that you, your product, or your service is endorsed, operated, certified, or approved by codeofwhisper.
We may restrict or block use where reasonably necessary to protect the website, its users, our systems, or our rights.
6. Intellectual property
The codeofwhisper website, Agent Hub, tool designs, software, interfaces, text, graphics, visual identity, logos, illustrations, branding, product names, documentation, and other original materials may be protected by copyright, trademark, design, database, or other intellectual property rights.
Unless expressly permitted, these Terms do not transfer ownership of any codeofwhisper intellectual property to you.
You may use the website and free tools for their intended purpose.
You may not, without permission:
- reproduce or redistribute substantial parts of the website or tools;
- copy or republish proprietary codeofwhisper materials as your own;
- use codeofwhisper branding, logos, artwork, product identity, or protected materials in a way that suggests authorization or affiliation where none exists;
- distribute an altered, copied, or derivative product as an original or official codeofwhisper product;
- remove or falsify copyright, attribution, trademark, authorship, or proprietary notices.
Rights belonging to third parties remain the property of their respective owners.
Nothing in these Terms limits rights that cannot lawfully be excluded under applicable law.
7. Availability and changes
We may improve, modify, replace, suspend, or discontinue website features or free Agent Hub tools from time to time.
Because Agent Hub tools are provided free of charge, we do not promise that every tool or feature will remain permanently available.
We aim to keep the website functioning reliably, but uninterrupted or error-free availability cannot be guaranteed.
Maintenance, technical problems, provider outages, security incidents, updates, or circumstances beyond our reasonable control may temporarily affect availability.
8. Third-party services and links
The website or individual tools may contain links to or interact with third-party websites, platforms, software, APIs, or services.
Third-party services are governed by their own terms and privacy practices.
Unless expressly stated otherwise, codeofwhisper does not control and is not responsible for the content, availability, security, or practices of independent third-party services.
A link to a third-party service does not by itself mean that codeofwhisper endorses that service.
9. Liability
Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by law.
codeofwhisper remains liable without limitation for damage caused intentionally or through gross negligence, and for injury to life, body, or health where liability exists under applicable law.
Where codeofwhisper negligently breaches an essential contractual obligation, liability for ordinary negligence is limited, to the extent legally permitted, to damage that was reasonably foreseeable and typical for that type of relationship.
Any mandatory statutory liability, including liability under applicable product liability law, remains unaffected.
Subject to the above and to the extent permitted by law, codeofwhisper is not liable for losses resulting solely from a user's failure to review, verify, or appropriately use an automatically generated tool output.
10. Privacy
Use of the website and Agent Hub may involve the processing of personal data.
Details about what data is processed, why it is processed, and users' data protection rights are provided in the codeofwhisper Privacy Policy.
The Privacy Policy forms a separate notice and is not replaced by these Terms of Use.
11. Changes to these Terms
We may update these Terms of Use where reasonably necessary, for example because the website changes, new free tools are introduced, legal requirements change, or the Terms need clarification.
The current version will be published on this page together with its effective or last-updated date.
Changes will apply prospectively.
Where applicable law requires additional notice or consent for a particular change, we will follow those requirements.
12. Applicable law
These Terms are governed by the laws of the Federal Republic of Germany, without prejudice to mandatory consumer protection provisions that apply under the law of a user's country of habitual residence.
If the user is a merchant, legal entity under public law, or special fund under public law, the legally permissible place of jurisdiction may be the provider's place of business.
Mandatory statutory rules concerning jurisdiction remain unaffected.
