Withdrawal Information
This information is for consumers who enter into a distance contract with codeofwhisper. Different rules apply to paid services and to paid digital content supplied by download.
Where a statutory right of withdrawal applies, the withdrawal period is generally 14 days from conclusion of the contract unless applicable law provides otherwise.
You do not need to give a reason for withdrawing.
To exercise a withdrawal right, send codeofwhisper a clear statement that you want to withdraw from the contract. This can be sent by email to hello@codeofwhisper.com.
You may use the model withdrawal form below, but you do not have to use it. Any clear statement that identifies the relevant contract and communicates your decision to withdraw is sufficient.
Paid Services
For paid service contracts, the withdrawal period generally starts when the contract is concluded.
If you expressly request that codeofwhisper begin the agreed service before the 14-day withdrawal period has ended, work may begin before that period expires.
If you withdraw after a service has begun following a valid early-start request, you may be required to pay a proportionate amount for the service already provided up to the time of withdrawal, where legally applicable.
The amount, where applicable, is based on the proportion of the agreed service actually provided rather than on an automatic fixed cancellation charge.
If a paid service is fully performed before the withdrawal period ends, the withdrawal right may expire only where the legal requirements for early performance and the consumer's required confirmations have been satisfied.
If the required early-start request or confirmation is not given, codeofwhisper will not intentionally begin a consumer service early where doing so would conflict with the applicable withdrawal rules.
Paid Digital Products & Downloads
Downloadable software and other paid digital content supplied without a physical data carrier are treated differently from services for withdrawal purposes.
A consumer may generally have a 14-day right of withdrawal from a distance contract for paid digital content. However, that right can expire before the 14 days have passed when all legal requirements for immediate digital delivery are met.
For codeofwhisper to provide a paid digital product immediately and rely on the early expiry of the withdrawal right, the consumer must expressly agree that performance may begin before the withdrawal period expires and must acknowledge that, by giving that consent, the withdrawal right is lost when performance begins.
codeofwhisper must also provide the required contract confirmation on a durable medium, such as email, recording the relevant consent and acknowledgement where required.
For a downloadable product, performance may begin when the download or other means of obtaining the digital content is made available to the consumer in accordance with the purchase flow.
If the required consent, acknowledgement, contract confirmation, or other legal requirement is missing, the withdrawal right does not simply disappear because a product is digital.
These withdrawal rules do not remove statutory rights relating to defective or non-conforming digital products. A loss of the withdrawal right is not the same thing as losing statutory rights if the supplied digital product is defective.
